What's in these terms?

These Terms apply to your access to and use of our website voicefortheplanet.com / voicefortheplanet.org (our 'site'), any downloaded content and any correspondence by e-mail between us and you. If you do not accept these Terms please do not use this site.
If you use the site (including downloading content from the website) you will be bound by these Terms whether or not you have signed up to add your voice to the Voice for the Planet, and they will form a contract between you and us.

By using our site, you accept these terms

By using our site, you confirm that you accept these Terms and that you agree to comply with them. You agree to only use the site in a manner that complies with all applicable laws and regulations and is consistent with these Terms and does not infringe the rights of anyone else, nor restrict or inhibit their use or enjoyment of the site.We amend these Terms from time to time if we believe it is reasonably necessary to do so (including for security, legal, or regulatory reasons), in which case the amended Terms will be posted on the site and will apply from the date we post them. Every time you wish to use our site, please check these terms to ensure you understand the terms that apply at that time. These terms were most recently updated on: December 2018.

Accessing the site

How you may use material on our site

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
You may print off copies, and may download extracts, of any page(s) from our site only for your personal use and non-commercial use.
You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Where you use such material, our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.

copyright and source indications are also printed and copied and/or stored in association with the Extracts;no modifications are made to the Extracts and Extracts are not used as part of any other publication or derivative work; and any Extract is retained, printed and/or copied entirely and is not used in a derogatory or misleading context and in particular may not be used for the purpose of promoting, advertising, endorsing or implying a connection with you (or any third party) and WWF-UK, its agents or employees.
The rights in this paragraph are not transferable and no other use of WWF Material may be made without first obtaining our written permission. We may terminate your rights to use or receive Extracts at any time at our complete discretion.


Contributions to our site

Whenever you make use of a feature that allows you to provide content to our site, or to make contact with other users of our site, you must comply with these Terms. All content posted or submitted by users of the site including to personal details provided to add your voice to the Call to Action for Nature in 2020 map, images, and pledges ('Contributions') must comply with the Terms.
You are solely responsible for Contributions which you post, transmit, publish or otherwise make available through the site. By uploading, posting, transmitting, publishing, displaying, or otherwise making available Contributions to our site, you agree that: you are the owner of all rights in such Contributions; you have waived all 'moral rights' that you may have in such Contributions, including but not limited to the right to be identified as the author of such Contributions; you have the right to allow our use of such Contributions under these Terms;all Contributions that you post are accurate; do not violate these Terms; will not result in a breach or violation of any terms of any contract or agreement to which you are currently bound or will become bound in the future, does not and will not violate any applicable law, and will not cause injury to any person or entity; andyou are at least 13 years old.
You warrant that any such Contribution does comply with the standards set out in these Terms, and you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty. You agree to indemnify and hold harmless WWF and its trustees, directors, officers and employees, from and against all liabilities, claims, demands and expenses arising out of any of your Contributions which breach these Terms.

Our Right to Use Contributions

Any content you upload to our site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us and other users of our site a limited licence to use, store and copy that content and to distribute and make it available to third parties.
We have the right to remove any Contributions if, in our opinion, your post does not comply with the content standards set out in these Terms.
You grant us a non-exclusive, perpetual, non-terminable, worldwide, sub licensable and royalty-free license to copy, modify, distribute, show in public and create derivative works form that material in any form and anywhere for all commercial or non-commercial purposes related to our work. You further authorise us to adapt the relevant material in the course of doing so and waive all moral rights you have in your Contribution to the fullest extent permitted by law.

Rules about linking to our site

If you wish to link from your website to our website you may do so only on the basis that you link to, but do not replicate, the home page, and subject to the following conditions:

Our responsibility for loss or damage suffered by you

Whether you are an individual or a business user, we do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
If you are a business user, we exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it. Furthermore, we will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

use of or reliance on any content displayed on our site.
In particular, we will not be liable for:

loss of anticipated savings;

If defective digital content that we have supplied, damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. However, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge or for damage that was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.


Severance

If any of these Terms should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country which apply to these Terms, then to the extent and within that jurisdiction in which that Term is illegal, invalid or unenforceable, it shall be severed and deleted from these Terms and the remaining Terms shall survive, remain in full force and effect and continue to be binding and enforceable.


Events outside our control

Neither you or WWF shall be responsible for damages or for delays or failures in performance resulting from acts or occurrences beyond their reasonable control, including, but not limited to: fire, lightning, explosion, power surge or failure, water, acts of God, war, revolution, civil commotion, or acts of civil or military authorities or public enemies; any law, order, regulation, ordinance, or requirement of any government or legal body or any representative of any such government or legal body; labor unrest, including but not limited to, strikes, slowdowns, picketing, or boycotts; or inability to secure raw materials, transportation facilities, fuel or energy shortages, or acts or omissions of other common carriers.


Which Country's laws apply to disputes

If you are a consumer, please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have jurisdiction. If you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland, and if you are a resident of any other country, you can bring proceedings in the courts of your country of residence.
If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
